Studio van Diepen LLC ("Company," "we," "us," or "our") operates this website, all courses offered through it, and related sites (collectively, the "Site") for the use of its customers, students, and other users ("Users"). By accessing or using this Site, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use this Site.

1. Acceptance of Terms

Use of this Site constitutes your agreement to these Terms and forms a binding legal agreement between you and Studio van Diepen LLC. These Terms apply to all Users, including visitors, registered account holders, and paying subscribers.

2. Account Registration

To access courses and paid content, you must create an account. You agree to:

Use of fictitious, generic, or unidentifiable names and email addresses does not exempt you from these Terms or from financial obligations incurred through your account.

3. Subscriptions, Free Trials, and Billing

Free Trial: We may offer a limited free trial period. By enrolling in a free trial, you authorize us to charge your payment method at the applicable subscription rate at the end of the trial period unless you cancel before the trial expires.

Subscription Billing: Subscriptions are billed on a recurring monthly basis at the rate displayed at checkout. Your payment method will be automatically charged at the start of each billing cycle.

Authorization: By completing checkout and providing your payment information, you expressly authorize Studio van Diepen LLC and its payment processors to charge your card for the subscription amount on a recurring basis.

Failed Payments: If a payment fails, we may retry the charge multiple times. Access to course content may be suspended if payment cannot be collected.

Price Changes: We reserve the right to change subscription pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new rate.

4. Cancellation Policy

You may cancel your subscription at any time through your account dashboard or by contacting us at [email protected]. Cancellation takes effect at the end of the current billing period. You will retain access to course content through the end of your paid period.

We are not responsible for cancellations that are not completed through the proper channels listed above. Filing a chargeback or dispute with your bank does not constitute cancellation.

5. Refund Policy

All sales are final. Due to the digital and immediately accessible nature of our course content, we do not offer refunds once course materials have been accessed, downloaded, or viewed.

Refund requests must be submitted to [email protected] within 7 days of the initial charge and only if no course content has been accessed. Refunds are issued at our sole discretion.

We reserve the right to deny refund requests where evidence shows that course materials were accessed, downloaded, or otherwise consumed prior to the request.

6. Chargebacks and Disputes

Before initiating a chargeback or payment dispute with your bank or card issuer, we strongly encourage you to contact us directly at [email protected]. We are committed to resolving billing concerns promptly.

If a chargeback is filed, we reserve the right to submit evidence to the issuing bank, including but not limited to: account access logs, download records, IP address data, login timestamps, and correspondence history. Fraudulent chargebacks may result in permanent account termination and recovery of associated fees.

7. Intellectual Property and Permitted Use

All course materials, content, downloads, PDFs, videos, and resources on this Site ("Materials") are the copyrighted property of Studio van Diepen LLC. Upon active subscription, Users are granted a limited, non-transferable, personal license to access and download Materials for individual study purposes only.

8. Digital Access and No Warranty

Course content is delivered digitally. We do not guarantee uninterrupted access and are not responsible for technical issues outside our control. Materials are provided "as is" without warranties of any kind.

9. Limitation of Liability

To the fullest extent permitted by law, Studio van Diepen LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of this Site or its content. Our total liability to any User shall not exceed the amount paid by that User in the three months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

11. Updates to These Terms

We may update these Terms at any time. Continued use of the Site after updates constitutes acceptance of the revised Terms. The most current version will always be available at aba-visualized.thinkific.com/pages/terms.
